WAYEQ هو تطبيق للصحة والتغذية يهدف إلى مساعدة المستخدم على متابعة الطعام والسعرات الحرارية والعناصر الغذائية والماء والوزن والأهداف، وقد يقدم وصفات واقتراحات للوجبات وأدوات أخرى مرتبطة بالتغذية ونمط الحياة.

المعلومات والحسابات والاقتراحات التي يقدمها WAYEQ مخصصة لأغراض معلوماتية ومساندة عامة فقط، ولا تمثل تشخيصًا أو علاجًا أو وصفة طبية أو استشارة طبية أو غذائية فردية.

2. الحساب

قد تحتاج إلى إنشاء حساب لاستخدام بعض ميزات WAYEQ.

أنت مسؤول عن تقديم معلومات صحيحة ومعقولة، والمحافظة على أمان بيانات الدخول إلى حسابك، وإبلاغنا إذا كنت تعتقد أن حسابك تعرض لاستخدام غير مصرح به.

لا يجوز استخدام حساب شخص آخر دون إذنه.

3. المعلومات الصحية والتغذوية

تعتمد بعض الحسابات والنتائج التي يعرضها WAYEQ على البيانات التي تدخلها، مثل العمر والطول والوزن ومستوى النشاط والأهداف والأطعمة والكميات.

هذه النتائج تقديرية وقد تختلف عن الاحتياجات الفعلية لكل شخص.

يجب استشارة طبيب أو اختصاصي صحي مؤهل عند وجود حالة صحية أو عند الحاجة إلى توجيه طبي أو غذائي متخصص.

ولا ينبغي استخدام WAYEQ في حالات الطوارئ الطبية.

4. السعرات الحرارية والمعلومات الغذائية

نسعى إلى توفير معلومات غذائية مفيدة ودقيقة قدر الإمكان، إلا أن القيم الغذائية قد تكون تقديرية وقد تختلف بسبب حجم الحصة أو العلامة التجارية أو طريقة التحضير أو مصدر البيانات أو اختلاف المكونات.

تقع على المستخدم مسؤولية تقييم مدى ملاءمة المعلومات لاحتياجاته الشخصية.

5. اقتراحات الوجبات والأهداف

قد يقدم WAYEQ اقتراحات مبنية على أهداف المستخدم أو السعرات الحرارية أو العناصر الغذائية المتبقية خلال اليوم.

هذه الاقتراحات أدوات مساعدة وليست تعليمات طبية، ولا يضمن WAYEQ أن اقتراحًا معينًا مناسب لكل مستخدم أو حالة صحية.

6. الاشتراكات والميزات المدفوعة

قد يوفر WAYEQ ميزات مجانية وميزات تتطلب اشتراكًا مدفوعًا.

سيتم عرض السعر ومدة الاشتراك وشروط التجديد للمستخدم قبل إتمام عملية الشراء.

عند شراء الاشتراك من خلال Apple App Store أو Google Play، تتم عملية الدفع وإدارة الاشتراك وفقًا لشروط وسياسات المنصة التي تم الشراء من خلالها.

يمكن للمستخدم إدارة أو إلغاء الاشتراك من خلال إعدادات حسابه لدى المتجر المعني وفقًا لسياسات المنصة.

حذف تطبيق WAYEQ أو حذف الحساب لا يؤدي بالضرورة إلى إلغاء اشتراك نشط لدى Apple أو Google، ولذلك يجب إدارة الاشتراك من خلال المنصة التي تم الشراء منها.

7. استرداد المدفوعات

تخضع طلبات استرداد قيمة المشتريات أو الاشتراكات التي تتم من خلال Apple App Store أو Google Play لسياسات وإجراءات الاسترداد الخاصة بالمنصة التي تمت من خلالها عملية الشراء.

لا يضمن WAYEQ الموافقة على طلب استرداد يخضع لقرار Apple أو Google.

8. الاستخدام المقبول

لا يجوز استخدام WAYEQ بطريقة غير قانونية أو محاولة:

• الوصول غير المصرح به إلى حسابات أو أنظمة أخرى.
• تعطيل التطبيق أو بنيته التقنية.
• التحايل على الاشتراكات أو القيود المفروضة على الميزات.
• نسخ أو استخراج أو إعادة توزيع محتوى التطبيق بصورة غير مصرح بها.
• استخدام الخدمة بطريقة تنتهك حقوق الآخرين أو القوانين المعمول بها.

9. المحتوى الذي ينشئه المستخدم

قد يسمح WAYEQ للمستخدم بإنشاء أو حفظ محتوى شخصي، مثل الوجبات أو الوصفات أو الصور أو البيانات الأخرى.

يظل المستخدم مسؤولًا عن المحتوى الذي يقدمه وعن امتلاكه الحقوق اللازمة لاستخدامه.

يمنح المستخدم WAYEQ الإذن التقني اللازم لتخزين ومعالجة هذا المحتوى بالقدر الضروري لتقديم الخدمة له.

10. حقوق الملكية الفكرية

يظل تطبيق WAYEQ وتصميمه وهويته ومحتواه الأصلي وقواعده البرمجية والعناصر المحمية الأخرى ملكًا لأصحاب الحقوق المعنيين.

لا تمنح هذه الشروط المستخدم حق ملكية في WAYEQ أو محتواه، وإنما حقًا محدودًا لاستخدام الخدمة وفقًا لهذه الشروط.

11. توفر الخدمة والتغييرات

قد نقوم بتحديث WAYEQ أو إضافة أو تعديل أو إزالة بعض الميزات بهدف تطوير الخدمة أو لأسباب تقنية أو تشغيلية أو قانونية.

لا نضمن أن الخدمة ستكون متاحة دون انقطاع أو أخطاء في جميع الأوقات.

12. تعليق الحساب أو إنهاؤه

يجوز اتخاذ إجراءات مناسبة، بما في ذلك تقييد أو تعليق الوصول إلى الخدمة، عند وجود استخدام مخالف لهذه الشروط أو إساءة استخدام للخدمة أو تهديد لأمان WAYEQ أو مستخدميه، وفقًا للقانون المعمول به.

13. حذف الحساب

يمكن للمستخدم طلب حذف حسابه وبياناته وفقًا لسياسة الخصوصية وآلية حذف الحساب المتوفرة في WAYEQ.

حذف الحساب لا يلغي تلقائيًا اشتراكًا قائمًا تتم إدارته من خلال Apple أو Google.

14. حدود المسؤولية

إلى الحد الذي يسمح به القانون، يقدم WAYEQ الخدمة والمعلومات والأدوات لأغراض المساعدة العامة ولا يضمن أن النتائج أو التقديرات ستكون دقيقة أو مناسبة لجميع المستخدمين في جميع الظروف.

Welcome to WAYEQ. These Terms of Use govern your use of the WAYEQ application and its related services and features. By using the application or creating an account, you agree to comply with these Terms.

1. Nature of the Service

WAYEQ is a health and nutrition application designed to help users track food, calories, macronutrients, water intake, weight, and personal goals. It may also provide recipes, meal suggestions, and other nutrition and lifestyle-related tools.

The information, calculations, and suggestions provided by WAYEQ are intended for general informational and supportive purposes only. They do not constitute medical advice, diagnosis, treatment, a prescription, or individualized medical or nutritional advice.

2. Your Account

You may be required to create an account to use certain WAYEQ features.

You are responsible for providing reasonably accurate information, maintaining the security of your account credentials, and notifying us if you believe your account has been accessed or used without authorization.

You may not use another person's account without permission.

3. Health and Nutrition Information

Some calculations and results provided by WAYEQ are based on information you provide, such as your age, height, weight, activity level, goals, foods, and serving quantities.

These results are estimates and may differ from an individual's actual needs.

WAYEQ should not be used for medical emergencies.

4. Calories and Nutrition Information

Users are responsible for determining whether information provided by WAYEQ is appropriate for their individual circumstances and needs.

5. Meal Suggestions and Goals

WAYEQ may provide suggestions based on a user's goals, calories, or remaining macronutrient targets.

These suggestions are supportive tools and not medical instructions. WAYEQ does not guarantee that any particular suggestion is appropriate for every user or medical condition.

6. Subscriptions and Paid Features

WAYEQ may offer both free and paid features.

The applicable price, subscription duration, and renewal terms will be displayed before a purchase is completed.

When a subscription is purchased through the Apple App Store or Google Play, payment and subscription management are subject to the terms and policies of the platform through which the purchase was made.

Users can manage or cancel their subscriptions through the applicable store account settings, subject to the platform's policies.

Deleting the WAYEQ application or deleting a WAYEQ account does not necessarily cancel an active subscription managed by Apple or Google. Users must manage such subscriptions through the platform where the subscription was purchased.

7. Refunds

Refund requests for purchases or subscriptions made through the Apple App Store or Google Play are subject to the refund policies and procedures of the platform through which the purchase was made.

WAYEQ does not guarantee approval of refund requests where the refund decision is controlled by Apple or Google.

8. Acceptable Use

You may not use WAYEQ unlawfully or attempt to:

• Gain unauthorized access to other accounts or systems.
• Disrupt or interfere with the application or its technical infrastructure.
• Circumvent subscriptions or feature-access restrictions.
• Copy, extract, reproduce, or redistribute application content without authorization.
• Use the service in a manner that violates the rights of others or applicable laws.

9. User-Generated Content

WAYEQ may allow users to create or save personal content, including meals, recipes, images, or other information.

Users remain responsible for the content they provide and for ensuring they have the necessary rights to use that content.

Users grant WAYEQ the limited technical permission necessary to store and process such content solely to the extent required to provide the service.

10. Intellectual Property

The WAYEQ application, its design, branding, original content, software, and other protected materials remain the property of their respective rights holders.

These Terms do not transfer ownership of WAYEQ or its content to users. They provide only a limited right to use the service in accordance with these Terms.

11. Service Availability and Changes

We may update WAYEQ or add, modify, or remove features for development, technical, operational, security, or legal reasons.

We do not guarantee that the service will always be available without interruption or error.

12. Account Suspension or Termination

Appropriate action, including restricting or suspending access to the service, may be taken where an account is used in violation of these Terms, where the service is abused, or where use presents a security risk to WAYEQ or its users, subject to applicable law.

13. Account Deletion

Users may request deletion of their WAYEQ account and associated data in accordance with the WAYEQ Privacy Policy and the account-deletion mechanism provided by WAYEQ.

Deleting a WAYEQ account does not automatically cancel an active subscription managed through Apple or Google.

14. Limitation of Liability

To the extent permitted by applicable law, WAYEQ provides its service, information, calculations, and tools for general supportive purposes and does not guarantee that estimates or results will be accurate or appropriate for every user in every circumstance.

WAYEQ is not a substitute for professional healthcare or medical evaluation.

Nothing in these Terms excludes or limits any rights or liabilities that cannot lawfully be excluded or limited under applicable law.

15. Privacy

WAYEQ's handling of personal data is governed by the WAYEQ Privacy Policy, which complements these Terms.

16. Governing Law

To the extent permitted by applicable law, these Terms are governed by the laws of the Kingdom of Bahrain, subject to any mandatory consumer rights that may apply based on the user's place of residence or the platform through which a purchase was made.

17. Changes to These Terms

We may update these Terms when the service changes or when legal, security, technical, or operational requirements change.

The updated version will be published with a revised “Last Updated” date. Additional notice will be provided where required.
